Since the Data Act became applicable on 12 September 2025, operators of connected industrial equipment have had a legal right to access, use and share the data those machines generate - a right that underpins many industrial-AI use cases such as predictive maintenance and cross-company benchmarking.

A factory running IoT-enabled equipment can now pull its own performance data and hand it to whichever analytics or AI provider it prefers, rather than being tied to the original equipment manufacturer's own software stack. From 12 September 2026, newly placed connected products must be built so that this access works by default. The Commission has published non-binding model contract terms to help data holders and users, including AI system providers, agree fair terms for data access and reuse. Building on this guidance, the Commission has also launched a dedicated Data Act Legal Helpdesk, offering stakeholders free, concrete answers to specific legal questions about applying the Regulation - a practical route for manufacturers unsure how the rules apply to their own connected products.
